te visito Alicante el jurista argentino (Córdoba, 1927) Ernesto Garzón Valdés cuyas conferencias puede escuchar en el blog de Aramburo desde estos links que remiten allí.- ¨Desnutrición y deberes positivos generales¨ en el Seminario Interdisciplinar de Bioética y nutrición, en donde a partir de la diferenciación entre ¨calamidad¨- producida por la acción del hombre - y catástrofe - producida por circunstacias naturales - explica la posible responsabilidad de los gobiernos y los gobernantes en situaciones como la desnutrición y las hambrunas, las consecuencias de los biocombustibles y de la liberalización de los mercados que proponía Adam Smith en el capítulo IV de La Riqueza de las Naciones, especialmente con las experiencias de Honduras y Haíti.

- ¨Restricciones de la democracia respresentativa¨ en donde se habla de Kelsen y su teoría procedimental de la democracia propuesta en ¨Esencia y valor de la democracia¨ (1920) , y que estudia a los autores optimistas y pesimistas que han analizado la idea de democracia a lo largo de los tiempos.
Al escuchar a Garzón Valdés, con 82 años de edad, nos damos cuenta de que su pensamiento polemiza y debate con la filosofia contemporánea como si fuera un jurista recien salido de la facultad, y que tal vez la madurez sea la mejor edad para empezar a filosofar a la manera kantiana del viejo filósofo.

Die Mauer Fällt: 20 años de la caída del Muro de Berlín

La celebración de ayer, como lo había descrito Appelbaum en su columna del Washington Post, fue Kitsch o loba en términos colombianos. Sobretodo lo que tuvo que ver con la representación con efecto domino de la Caída del Muro. Se habían instalado una serie de muros de cartón con grafities a la manera del antiguo Muro para que al final de la ceremonia se fueran cayendo uno a uno. En mitad del camino uno de los muritos de cartón fallo y el efecto domino se quedo parado en mitad de camino produciendo la risa irónica de los que habían dicho que esto iba a pasar. Los chinos en las Olimpiadas demostraron que hacer pregrabados y trucos de edición impedía este tipo de errrores. Sin embargo, los berlineses confiaban en la exactitud alemana que fallo ayer.
Fallo también Barack Obama, que fue reemplazado por Hillary Clinton que como todo Presidente norteamericano que va a dar un discurso a Berlin quizo emular a J.F.K con su frase ¨Ich bin ein berliner¨. El discurso de Kennedy fue pronunciado en pleno embargo de la Unión Soviética a Berlin en 1963 cuando la Guerra Fría se estaba calentando y la lucha por la ciudad histórica alemana se convertía en el centro de esa tensión. Ayer falto Obama como nuevo presidente histórico de nuestra era. Al parecer se encuentra ocupado en su país tratando de aprobar la reforma a la salud pero esto no era motivo para faltar porque veinte años son veinte años y al fin y al cabo no se repiten. Quizás quiera esperar a la celebración de los veinticinco años pero ya no será lo mismo.
Falto también Scorpions el grupo de rock alemán que con su ¨Wind of change¨ produjo la banda sonora de este acontecimiento que al parecer fue reemplazado por Bon Jovi. Gorbachov y Lech Walesa, así como el narizón Sarkozy fueron los que más robaron cámara. Gordon Brown, el Primer Ministro de Inglaterra ya es reconocido por su falta de carisma así que no se gano ni una toma. Se vio algunas veces al presidente de Rusia Dimitri Mdvédev con un aparatito de traducción, sin embargo Mdvédev todavía es opacado por la sombra de su titiritero Putin y nadie a nivel internaciona lo reconoce todavía. Así que ante tanto ausente le toco a Angela Merkel ponerse los pantalones y robarse el show. En su discurso fue emotiva e incluso se vio bonita, para ella como ¨Ozzi¨ u originaria de Alemania Oriental, la Caída del Muro fue el acontecimiento más feliz de su vida. Dijo que lo que vino después no fue fácil, la falta de una integración real y los muros invisibles que todavía subsisten, pero la libertad es algo que no tiene precio y salir de la opresión ameritó el cambio.
Veinte años ya, 9 de noviembre de 1989, yo me encontraba saliendo del colegio, tal vez en examenes y las imágenes de la Caída parecía algo histórico pero no definitivo. Es decir nadie creía que ahí terminaría la Unión Soviética, ya el ¨Hombre Nuclear¨ y hasta el ¨Super Agente 86¨ nos habían enseñado de chiquitos que los rusos no eran de confianza y que tal vez esto sería otra más de sus estrategias calculadas para ganar poder. Sin embargo, a los pocos meses todo cambio y el comunismo se acabo. También el miedo a la guerra nuclear y la tensión permanente de un mundo dividido y en permanente confrontación. Ayer fue la celebración de este acontecimiento, para muchos era un momento de nostalgia y de lágrimas para otros de entera felicidad. Para mi fue el constatar que el tiempo pasa y que voy siendo testigo de este trasegar

Spanish: Iureamicorum se vuelve bilingüe. Iureamicorum ha tomado clases de inglés y va a postear algunas entradas en este idioma. Por qué? Por que pienso que el entendimiento del derecho tiene que extenderse a todo el mundo, y el inglés, como todo el mundo sabe, es la la lingua franca que hace esto posible. La idea vino de mi antigua ayudante Luz Helena Beltrán. Luz Helena, que ahora vive en Sudáfrica, me pregunto si podia traducir un post relacionado con mi idea de postneoconstitucionalismo, y dije que si. Aquí esta el resultado. Luz Helena gracias por tu ayuda. Estamos pensando en abrir Iureamicorum en una versión en inglés. Este blog nos ayudará a comunicarnos con el mundo no hispanico. Neoconstitutionalism, Postneoconstitutionalism. The understanding of principles in Alexy and Dworkin

Fundamental rights, as principles (optimization mandates), according to Prieto Sanchis and Carlos Bernal’s interpretation would be ponderable, and the rules, would work with the formula of “everything or nothing” - or subordination-.The classical example of criminal law in which "The one who killed another will receive a sentence of 30 years of prison” would work as a rule because it is configured by a hypothetical proposition “the one who killed”, a link of imputation “will receive” and a legal consequence “a sentence of 30 years in prison”. Therefore, the judge, when verifying the hypothesis mentioned by the rule will establish the sentence subordinating the fact in it as if he was a machine.
To do this he must use techniques like ponderation (suitability, necessity and ponderation in a strict sense, or in the case of the equality, the anglosaxon technique of the suspicious criteria of discrimination – strict and soft scrutiny).
There are other examples in the first chapter of Dworkin’s book that illustrate the possibility of applying principles over rules. For example, the case of the Snail Darter in which it was forbidden to build a dam because this could violate a statute about the endangered species (in this case the endangered species was a small fish of 8cm that according to Dworkin had no attraction whatsoever).
Taking into account such cases given by Dworkin in his text, it is considered that Alexy’s interpretation about what principles are, is not the only correct one. When Dworkin refers to principles, he is not thinking only in terms of fundamental rights (for example the equality in Brown) but also in jurisprudential criteria or principles that the continental academics call “general principles of law”, such as the “malicious profit” from the murdering grandson. In this, the philosophical enunciate (PE) of “Principle” in the Dworkinian explanation would be much wider than the PE of “Principle” in Alexy’s explanation. However according to Wittgenstein, this would be tantamount to “diverse language games”.
There are of course problems of interpretation for the systems of continental tradition. This is because our understanding of Dworkin is adapted to our own system without taking into account that what he is doing is a theory of constitutional law for the Anglo-Saxon case.
The same happens to the continental translation of the idea of the principles. This would start from a supposition or inference although these do not originate from what Dworkin aims to portray in his book. For him, “Principles” are not only the fundamental rights inserted in the constitutions of continental tradition. In fact, the concept of fundamental right is German (Grundrecht) and the Anglo- Saxons do not use it. For Dworkin the principles would be those criteria of legal resolution that would not only overcome the rules but would also be composed by the rights enunciated in the amendments of the Bill of Rights, jurisprudential precedents, and general principles of law.
It is noted that these do not necessarily have to be a rule following the idea of inclusive positivism of Waluchow. Instead they are standards of legal solution related to justice, equity and to some extent morality.On this premise, and if one wants to be faithful to Dworkin, one must conclude that the dworkinian idea of principles is much more daring than Alexy’s proposal. Dworkin is thinking per the Law of Anglo Saxon tradition which is formed, overall, by precedents and jurisprudential criteria. The Alexyan are worried about finding fundamental rights that can work as optimisation principles and that can be used to solve a case by using ponderation.

The Brandon Research Fellowship: una buena beca para internacionalistas en la Universidad de Cambridge

The Lauterpacht Centre for International Law is pleased to announce the establishment of the Brandon Research Fellowship, funded by the generous gift of Mr Michael Brandon MA, LLB, LLM (Cantab.), MA (Yale), Member of the English Bar (1952) and a Fellow of the Chartered Institute of Arbitrators (1992).
The Brandon Research Fellowship will be awarded on an annual basis and is intended to cover a stay of at least 8 weeks at the Lauterpacht Centre for International Law. The first Fellowship, for 2010, will be worth £3000; any additional travel or other expenses will be the responsibility of the Fellow. Two awards may be made if the strength of the field warrants it.
The Brandon Research Fellow will undertake a project on some aspect of public or private international law or international arbitration while based at the Lauterpacht Centre. Candidates must specify a project in their application. Fellows must produce a report of their work in English at the end of their Fellowship and deposit with the Lauterpacht Centre any publication resulting from the work undertaken during the Fellowship.
Candidates must be fluent in English and at least one of French, German or Spanish. Preference will be given to candidates who are born nationals of members of the European Union (as it was constituted on 1 January 2005); members of the British Commonwealth; Argentina; Brazil; Chile; Switzerland; and the United States of America. Information on requirements and eligibility can be found in the guidance notes below.
The Lauterpacht Centre provides a centre for research in Cambridge for legal practitioners and academics from around the world. The Brandon Research Fellow will be welcomed as part of the community of Visiting Fellows at the Centre. While in Cambridge, Visiting Fellows have the opportunity to meet with other scholars in their field. Visiting Fellows are encouraged to participate fully in the activities of the Centre, including lectures and work in progress seminars on international law and related subjects, and have access to the law libraries in the Centre and the Faculty of Law.
APPLICATION DEADLINE: 30 November 2009
Applications should be submitted in accordance with the guidance notes and using the application form available on the Lauterpacht Centre website. The application should consist of the following:
- completed Application Form (including an outline of the proposed research);
- a curriculum vitae (max 4 pages);
- two letters of reference.
All documents should be prepared in English. Applications must be received by 30 November 2009. Late or incomplete applications will not be considered.
